Placing of an order, whether orally or in writing) and whether or not based on a quotation or not, shall be deemed subject to the Conditions which shall apply to the exclusion of any other provisions contained in any other document issued by the purchaser and without prejudice to the generality to the foregoing, contained in any order sent by the purchaser.

Reference numbers where manufacturers part numbers are quoted, these are only for reference and description purposes and for the avoidance of doubt, and these do not mean that the parts referred to are genuine spare parts made or used by any manufacturer.

Amendment to Our Company's Conditions

No modification or amendment of the conditions shall be binding upon the company unless agreed to in writing by a duly authorised signatory on behalf of the company.

Term of Liability & (Liability whatsoever)

This shall include without prejudice to the expression all liability in tort, contract, breach of representation of implied warranty or condition or any other duty at common law or under the expressed terms of the contract including any liability for direct or indirect or consequential loss including but not limited to loss of profit or damage of any kind howsoever caused or arising. The said term will, however, not apply to liabilities in respect of death or personal injury.
Unless otherwise agreed in writing all drawings, specifications, descriptions, and particulars of dimensions or weights provided by our company or otherwise contained in the company's website, catalogues, brochures, price lists or any other published matter are approximate only and do not form part of a contract or give rise to any independent or collateral liability whatsoever upon the part of the Company being intended merely to present a general idea of the goods as described therein.

Special Orders

Special orders are Goods that have been provided by the Company upon the special specification or requirements of the purchaser, which are not ordinarily provided by the Company or advertised by the Company.

ACT 1977

Nothing in these Conditions shall exclude or restrict the Statutory Rights of the purchaser who deals as a consumer within the meaning of the (Unfair Contract Terms Act 1977).

Transfer of Property

Legal and beneficial ownership of all ordered goods and products shall remain with the company until full payment for the goods and products and any other charges due by the purchaser has been made in full.

Delivery Of Goods

Unless otherwise stated in writing any date or time for the delivery should start from the date on which acceptance of the order is communicated to the purchaser.
Failure to deliver by any particular time or date will not entitle the purchaser to cancel the contract nor shall the Company be liable for any loss or liability whatsoever arising in respect hereof.
The company shall not be responsible for any delays caused by any weather conditions, via its suppliers, human error or any other factor beyond its reasonable control.
Delivery date and time that may be given is intended as an estimate only and will not be a contractual obligation & that given time and date or any other time for collection or delivery shall not be deemed to be of the essence in respect of this contract.
Without prejudice the following shall be regarded as forces beyond reasonable control: Explosion, Fire, An act of God, An accident, Civil disturbance, Flood, War / threat of war, Sabotage. Import or export regulations or embargo, Regulations and Restrictions, bye-laws, Acts, Parliamentary or local authority problems or regulations, Problems in obtaining raw material, Industrial actions or strikes, Trade disputes, Power failure / breakdown of machinery, Purchaser failing to collect goods.
Without prejudice to any rights of the company hereunder: If purchaser fails to give on or before the agreed date for delivery all instructions reasonably required by the Company and all necessary documents, consents and authorities (for which the Purchaser is obliged under the Conditions or by law to obtain) for forwarding the goods or shall otherwise cause or request delay, the Purchaser shall pay to the Company all costs and expenses incurred arising from such delay.

Risk On Delivery Of Goods

The Goods shall be at the Purchaser's risk from the start of the first point of time of any of the following events:
(a) Physical delivery of the goods to the Purchaser's carrier, (b) Physical delivery of the goods to the Purchaser at the Company's place of business, (c) The physical delivery of the goods to the Purchaser's home, place of their business or any other address as notified by the Purchaser to the Company. (d) Goods shall remain at the Purchaser's risk not withstanding any subsequent return or retaking of possession by the Company in accordance with these conditions.

Back Orders

If your required item/s is/are not in stock, we will order it for you, we will keep you informed of the delivery time, if you can not find what you are looking for on our website, please do contact us and we will do our best to get it for you as soon as possible, we will get the price for the required product and inform you by e-mail or by calling you, if the price and the waiting time for the delivery of your required goods is acceptable to you, then we will order it for you, there are lots of items, which are not listed on our website, for which we do hold extra catalogues in our shop premises, so you can always visit us to view these catalogues for yourself for finding what you are looking for.

Price

Unless otherwise stated the price of the products and goods in respect of contracts for delivery in Great Britain or any part of Europe, excludes the cost of delivery. Any and all charges for VAT or other applicable taxes and duties and costs including costs of carriage as determined by the company at date of dispatch shall be payable by the purchaser to the Company.
Unless otherwise stated in writing any quotation is based on the current cost of materials, labour, transport, overheads, other charges and the price quoted is subject to fair adjustment indicating any increases in the cost of materials, labour, transport, overheads or other charges incurred by our company during the period between the date of the quotation and the date of dispatching the goods or products.
Purchaser will not be entitled to make any deduction from the price of the goods or products in respect of any set-off or counterclaim or indemnity or otherwise unless expressly agreed in writing by our company.

Payment Terms

Unless otherwise agreed, the purchaser will pay for all goods in advance of receipt by either pro forma invoice, credit or debt charge card, cash or by such other form of cleared funds as agreed by the company. Our company will retain a handling fee of 2% on all purchases made by credit card.
If payment is made by cheque it shall not be deemed to have been made until the cheque has been honoured by the drawer's bank and cleared in the company's bank account.
Failure to pay the price for any products, which is supplied or for any part of the price thereof or any other amount payable by the purchaser under these conditions, this will entitle our company without prejudice to the company's other rights or to refuse to make delivery of any further orders or consignments of goods under this contract or goods under any other contract or to cancel any uncompleted order/s without consulting the purchaser and such action shall not be regarded as a breach of these terms and conditions and no liability whatsoever whether direct or indirect shall attach to the company in relation thereto whether by means of any counterclaim, set off, indemnity or by any other means howsoever arising.
If the purchaser has a credit account with our company, all payments will become due thirty days after thirty days from the invoice date. Our company reserves the right to charge interest at a rate of 2% per month or part thereof on all amounts unpaid by the due date, our company will be entitled to the same until payment in full has been received.
Any payment/s received by our company will be applied first in settlement of any charge to interest or other costs or expenses howsoever invoiced or incurred by our company then in settling the purchase price or principal sum or sums due to the company.

Deposits:

Deposit on Accessories: Any deposit taken on a product to be ordered in for you which isn’t in stock, is a none refundable deposit, not unless if we can’t get the product in for you, then we will contact you and refund the full amount of the deposit back to you.
Deposit on Vehicles: Any deposits taken on any of our vehicles (Motorcycles or Trikes or any vehicles that we have on sale in the future) is a none-refundable deposit.
If the order is placed online from our website or over the phone indicates that you have agreed with our full terms and conditions.
